A last will & testament is a legal document that lets you choose who you want to receive your property / possessions when you pass away. Very importantly, it allows you to name a guardian to care for minor children. The main purpose of a will is to ensure that your wishes, not the default laws of the state, will be followed upon the your death.
A testamentary trust is a trust established in a last will & testament, typically for the benefit of minor children. This trust allows you to leave property / inheritance to minor children, with the understanding that adults you choose will manage that property / inheritance until your child reaches a certain age(s).
A durable power of attorney gives someone you choose the power to act in your place. With a valid POA, this person will be legally permitted to take care of important matters for you (i.e. paying your bills, managing your investments, transacting personal business, etc) if you are unable to do so yourself.
A health care power of attorney is a document in which you designate someone to be your representative, or agent, in the event you are unable to make or communicate decisions about all aspects of your health care.
An advance medical directive states your health care wishes in the event you are medically determined to be permanently unconscious or terminally ill by at least two physicians. This is commonly known as the "pull the plug document".
In Louisiana, if someone dies without a will and has an estate valued at less than $125,00, an Affidavit of Small Succession can be used in lieu of probate to transfer the property of the deceased to the rightful heirs. Also, if someone has died with a Will that was probated in another state, and the value of the property located in Louisiana is less than $125,000, an Affidavit of Small Succession can be used to transfer the property located in Louisiana to the rightful heirs in lieu of probate.
